Visa

Family visa in Brazil

Brazil's family visa (VITEM XI) lets a spouse or partner, child, parent, grandparent, grandchild or sibling of a Brazilian citizen or a foreign resident join them in Brazil. You show the family tie and your relative's declaration. Your residence ends when theirs does, or is indefinite if theirs is.

Who it’s for

  • The Migration Law gives the visa or residence for family reunion to a spouse or partner (without discrimination), a child of a resident immigrant or someone who has a Brazilian or resident-immigrant child, an ascendant, a descendant to the second degree or a sibling of a Brazilian or of a resident immigrant, and anyone with a Brazilian under their guardianship.
  • The regulation adds that the call cannot come from someone whose own residence is based on family reunion or is provisional, and that a sibling over 18 must prove economic dependence on the relative who calls.
  • New York adds details: stepchildren under 18 (up to 24 if students, any age if dependent), a parent of a Brazilian only if they will live with the child at the same address, and no visa if the marriage was by proxy. Canberra also excludes marriages or unions by power of attorney.
  • Canberra says the holder of the visa may perform remunerated activities in Brazil. Dependants of a work or investor visa holder can use this visa too.

Money tests

  • The law and regulation set no income amount for the family member. New York asks for proof of income to cover the stay, such as bank or credit card statements or pay stubs, and an affidavit of financial support signed by the Brazilian relative.
  • Wellington asks for proof of means to sustain you and your partner, from either of you, such as funds in Brazil or overseas, a work contract with regular income or scholarships. It states no amount.

Documents

  • New York lists a passport with a blank visa page, the printed receipt of the online form, a 2 by 2 inch photo, an airline ticket or itinerary, your original birth certificate, proof of the relationship (a birth or marriage certificate), an FBI background check issued within the last 3 months and a copy of a green card or valid US visa if you are not a US citizen.
  • It also asks for the affidavit of financial support signed by the Brazilian relative, an original or notarised copy of that relative's passport, Brazilian ID or residence card, and for minors a consent form signed by both parents.
  • Istanbul asks for criminal records from the applicant's country of nationality, a document showing the tie, the sponsor's identity document and a declaration signed by the sponsor that they live or plan to live in Brazil.

Timing

  • You apply for the temporary visa at a Brazilian consulate, and Wellington notes it may need to ask Brazil's foreign ministry for authorisation for some nationalities. Canberra says the terms are based on Interministerial Ordinance No. 12/2018.
  • Toronto says a visa typically takes 10 business days from the day the consulate physically receives your file and advises applying at least 15 business days before you travel. Canberra says about 2 weeks, with no express service.
  • Within 90 days of first arrival you must register with the Federal Police, presenting the Visa Application Form issued with the visa. The government estimates about 30 business days for the last step and up to 180 calendar days overall.

Fees

  • New York lists US$290 for US passport holders and US$100 for other nationalities. Toronto lists CA$150 as its general fee and states no separate family fee, Sydney lists A$190 for Australian passport holders and Wellington lists NZ$200.
  • If your residence request is made inside Brazil, the government's processing and evaluation fee is R$168.13, and the CRNM residence card costs R$204.77.

How long it lasts and renewal

  • The regulation ties the family member to the relative who calls. If the relative has a fixed-term residence, yours expires on the same date; if theirs is indefinite, yours is granted for an indefinite term too.
  • Canberra and Istanbul say the temporary visa is valid for up to one year, and Canberra adds that the Federal Police sets the initial residence period at registration, up to one year. Holders with residence of more than a year can then enter on their passport and CRNM card.

Path to permanent residence

  • Someone who held residence for family reunion can ask for new residence for an indefinite term after at least four years in Brazil, with proof of means of subsistence and a criminal record certificate.
  • Ordinary naturalisation needs four years of residence, but the period drops to a minimum of one year if you have a Brazilian spouse or partner, and are not separated from them when it is granted, or a Brazilian child.

Tax

  • A temporary visa holder with no employment relationship in Brazil becomes a Brazilian tax resident the day after completing more than 183 days, consecutive or not, within a 12-month interval from any arrival. Someone who enters on a permanent visa is taxed as a resident from arrival.
  • A resident is taxed on income from any location, and foreign tax is deductible only if a treaty provides for it or there is reciprocal treatment. The sources we read give no special tax rule for a family reunion visa holder or for a spouse of a Brazilian.
